Notice to Authorised Reseller of Addition of New Domains to Program

Date: November 2014

The following New Domain(s) are added to the Schedule “New Domains” in the Authorised Reseller Agreement between Melbourne IT and Authorised Reseller on the terms and conditions set out below.

This notice, and the ability to resell the below New Domains, are subject to the Authorised Reseller having entered into the appropriate contractual arrangements with Melbourne IT Ltd. For such Authorised Reseller’s, these terms and conditions (as may be updated from time to time) are hereby incorporated into the Authorised Reseller Agreement by reference. Terms defined in the Authorised Reseller Agreement and which are used in this notice shall have the same meaning, unless the context requires otherwise.

To the extent that any of the terms and conditions in this notice are inconsistent with any other provision in the Authorised Reseller Agreement, the below terms and conditions will prevail in respect of the relevant below New Domain(s).

Collectively, the above domains are referred to in this notice as the Domains.

^ Certain Domains may not be currently operational at the Registry. Availability is subject to the relevant Registry confirming the Domain is operational, and the Domain being available in the Melbourne IT Reseller Portal.

Pricing

The Service Charges payable by Authorised Reseller in respect of the above Domains for any single domain registration, renewal registration or transfer registration are as notified to Authorised Reseller by Melbourne IT. Authorised Reseller can contact resellersales@melbourneit.com to confirm these Service Charges.

Service Charges will increase immediately (and by an equal amount) if ICANN or the relevant Registry increases the fees payable by, or imposes new fees upon, Melbourne IT for an applicable Domain.

This pricing section, and Service Charges notified to Authorised Reseller by Melbourne IT are incorporated into Schedule A of the Authorised Reseller Agreement.

New Domain Policy

A. General Terms applicable to the above Domains

In addition to the general terms and conditions set out in the Authorised Reseller Agreement, the following terms and conditions apply in respect of each above Domain:

The Registration Agreement for the Domains is located at https://melbourneit.au/legals/reseller-new-gtld-notice/. Authorised Reseller represents and warrants that each Registrant of an above Domain agrees to this Registration Agreement and any additional Domain Name Policy terms and conditions applicable to that Domain (as notified to the Authorised Reseller by Melbourne IT from time to time).
Authorised Reseller agrees to reasonably cooperate with the Registry of each of the above Domain in the performance of its obligations in respect of that particular Domain.
Melbourne IT does not support or offer any ‘Premium Domain Names’ (meaning those Domain Names reserved or registered by a Registry (or by another party on behalf of that Registry) and which are made available at a higher variable price point for registration, renewals and transfers). Melbourne IT is currently providing domain name services in the general availability phase only for the above Domains. In the instance where Melbourne IT does support other phase(s) for particular Domain, Melbourne IT will notify the Authorised Reseller and provide the process and pricing for the supported phase(s).
Melbourne IT’s obligation to provide any of the above Domains to the Authorised Reseller under its Authorised Reseller Agreement is subject to: (i) any changes in the applicable local government and the relevant Registry’s policies and procedures; (ii) any changes in the ownership of the operator of the relevant Registry; and/or (iii) bankruptcy or insolvency of that operator. If Melbourne IT’s ability to meet these obligations is likely to be adversely affected by any of these listed events, Melbourne IT will notify the Authorised Reseller of the event and the anticipated impact. Unless expressly agreed in writing with Melbourne IT (with such agreement explicitly identifying each applicable Domain), no service levels apply to the services and/or provisioning of any of the above Domains by Melbourne IT to Authorised Reseller.
Authorised Reseller acknowledges that Melbourne IT may be required by the applicable Registry (or the entity responsible for operating the Registry (such as an ‘administrator’) to cease providing registrar services with respect to a particular Domain if the Authorised Reseller fails to comply with (i) these terms and conditions applying in respect of the above applicable Domain, and/or (ii) the Registry’s applicable Domain Name Policies.
Authorised Reseller agrees to publish on its website(s) and/or provide a link to the ICANN Registrants’ Benefits and Responsibilities Specification, currently located at https://www.icann.org/resources/pages/approved-with-specs-2013-09-17-en#registrant.
Authorised Reseller agrees not to use any Registry logo or graphic (unless it has the permission of the Registry) or hold itself out to be accredited by the Registry (unless it has achieved such accreditation).
Any Registry or ICANN related URL links provided are subject to change, and may be updated from time to time.

B. Additional Terms applicable to Donuts Domains

In addition to the general terms and conditions set out in the Authorised Reseller Agreement (including this notice and the above general terms), the following terms and conditions apply in respect of the Donuts Domains name spaces:

Authorised Reseller agrees that it will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on http://www.donuts.co. Domain Name Policies for the Donuts Domains are located at http://www.donuts.co/policies/.
In respect of each Donuts Domain, Authorised Reseller agrees to indemnify, defend and hold harmless the Registry and its affiliates and subsidiaries, as well as their respective owners, directors, managers, officers, employees, representatives, agents, service providers and contractors from and against any and all claims, damages, liabilities, costs and expenses of any kind, including without limitation reasonable legal fees and expenses (including on appeal), arising out of or relating to (i) any claim or alleged claim relating to any of its product(s) or service(s); (ii) any claim or alleged claim relating to any agreement with any Registrant that registers a domain name through Authorised Reseller; (iii) any claim or alleged claim relating to Authorised Reseller’s domain name registration business or other activities, including, but not limited to, Authorised Reseller’s advertising, domain name application process, systems and other processes, fees charged, billing practices and customer service; and/or (iv) any breach by Authorised Reseller of any of Registry’s Domain Name Policies. This indemnification obligation shall survive any termination or expiration of the Authorised Reseller Agreement.

C. Additional Terms applicable to Famous Four Media Domains

Authorised Reseller agrees that it will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on www.famousfourmedia.com. Domain Name Policies for the FFM Domains are located at www.famousfourmedia.com.

D. Additional Terms applicable to United Domains

Authorised Reseller agrees that it will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on http://rightside.co/. Domain Name Policies for the United Domains are located at http://rightside.co/rightside-registry/registrar-overview/policies/.
Authorised Reseller agrees to indemnify, defend and hold harmless the Registry and its affiliates and subsidiaries, as well as their respective owners, directors, managers, officers, employees, representatives, agents, service providers and contractors from and against any and all claims, damages, liabilities, costs and expenses of any kind, including without limitation reasonable legal fees and expenses (including on appeal), arising out of or relating to (i) any claim or alleged claim relating to any of Authorised Reseller’s product(s) or service(s); (ii) any claim or alleged claim relating to any agreement with any Registrant that registers a domain name through Authorised Reseller; (iii) any claim or alleged claim relating to Authorised Reseller’s domain name registration business or other activities, including, but not limited to, Authorised Reseller’s advertising, domain name application process, systems and other processes, fees charged, billing practices and customer service; and/or (iv) any breach by Authorised Reseller of any of Registry’s Domain Name Policies. Authorised Reseller further agrees not to enter into any settlement or compromise of any such indemnifiable claim without the Registry’s prior written consent, which consent shall not be unreasonably withheld. This indemnification obligation shall survive any termination or expiration of the Authorised Reseller Agreement (and/or Melbourne IT’s agreement with the Registry).

E. Additional Terms applicable to Uniregistry Domains

Authorised Reseller agrees that it will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on http://uniregistry.com/. Domain Name Policies for the Uniregistry Domains are located at http://uniregistry.com/.

F. Additional Terms applicable to GMO Domains

Authorised Reseller agrees that it will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on http://www.gmo-registry.com. Domain Name Policies for the GMO Domains are located at http://www.gmo-registry.com.
Authorised Reseller agrees to indemnify, defend and hold harmless the Registry, including the Registry’s directors, officers, employees, subcontractors and agents, to the maximum extent required by law, from and against any claims, damages, liabilities, costs and expenses arising out of or relating to any application and/or request for the registration of a domain name, and/or the use of a domain name.

G. Additional Terms applicable to .BAR Domains

Authorised Reseller agrees that it will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on www.centralnic.com. Domain Name Policies for .BAR are located at www.centralnic.com.
You shall not represent to any actual or potential Registrant that you (or Melbourne IT as registrar of record) enjoys access to any of the Registry’s systems that is superior to that of any other registrar accredited for .BAR.

H. Additional Terms applicable to .BUILD Domains

You agree that you will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on http://www.dotbuild.co/. Domain Name Policies for .BUILD are located at http://www.dotbuild.co/registrypolicies.php.

I. Additional Terms applicable to .BUZZ Domains

Authorised Reseller agrees that it will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on http://www.buzznames.biz/. Domain Name Policies for .BUILD are located at http://www.buzznames.biz/.
Authorised Reseller agrees to indemnify, defend and hold harmless the Registry and the Registry’s service provider, NeuStar, Inc., and their subcontractors, subsidiaries, affiliates, divisions, shareholders, directors, officers, employees, accountants, attorneys, insurers, agents, predecessors, successors and assigns, from and against any and all claims, demands, damages, losses, costs, expenses, causes of action or other liabilities of any kind, whether known or unknown, including reasonable legal and attorney’s fees and expenses, in any way arising out of, relating to, or otherwise in connection with the Registrant’s .BUZZ domain name registration. This indemnification obligation survive the termination or expiration of the Authorised Reseller Agreement.

J. Additional Terms applicable to .CEO Domains

Authorised Reseller agrees that it will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on http://www.nic.ceo/.

K. Additional Terms applicable to .CLUB Domains

Authorised Reseller agrees that it will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on http://nic.club/. Domain Name Policies for .CLUB are located at http://nic.club/Terms/.
Authorised Reseller agrees to indemnify, defend and hold harmless the Registry and the Registry’s service provider, NeuStar, Inc., and their subcontractors, subsidiaries, affiliates, divisions, shareholders, directors, officers, employees, accountants, attorneys, insurers, agents, predecessors, successors and assigns, from and against any and all claims, demands, damages, losses, costs, expenses, causes of action or other liabilities of any kind, whether known or unknown, including reasonable legal and attorney’s fees and expenses, in any way arising out of, relating to, or otherwise in connection with the Registrant’s .CLUB domain name registration. This indemnification obligation survive the termination or expiration of the Authorised Reseller Agreement.

L. Additional Terms applicable to .KIWI Domains

Authorised Reseller agrees that it will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on https://dot-kiwi.com/. M. Additional Terms applicable to .LONDON Domains

Authorised Reseller agrees that it will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on http://www.nic.london/. Domain Name Policies for .LONDON are located at http://www.dotlondondomains.london/registry-policies/.

N. Additional Terms applicable to .LUXURY Domains

You agree that you will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on http://www.dotluxury.com. O. Additional Terms applicable to .MELBOURNE Domains

You agree that you will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on http://nic.melbourne/. Domain Name Policies for .MELBOURNE are located at http://nic.melbourne/.

P. Additional Terms applicable to .MENU Domains

Authorised Reseller agrees that it will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on http://www.dot-menu.com/. Domain Name Policies for .MENU are located at http://www.dot-menu.com/.

Q. Additional Terms applicable to .PRICES Domains

Authorised Reseller agrees that it will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on http://www.radixregistry.com/. Domain Name Policies for .PRICES are located at http://www.radixregistry.com/.
You agree to fully defend, indemnify and hold harmless Registry and Registry’s members, officers, directors, agents, employees, and subcontractors for any loss, liabilities, damages, costs or expenses, including reasonable attorneys’ fees, resulting from any third party claim, action, or demand arising out any dispute in relation to any domain name registered by you in the Registry, including but not limited to (a) any claim or alleged claim relating to any of your product(s) or service(s); (b) any claim or alleged claim relating to any agreement with any Registrant that registers a domain name through you; (c) any claim or alleged claim relating to your domain name registration business or other activities, including, but not limited to, your advertising, domain name application process, systems and other processes, fees charged, billing practices and customer service; and/or (d) any breach by you of any of Registry’s Domain Name Policies. This indemnification obligation shall survive any termination or expiration of the Reseller Agreement (and/or our agreement with the Registry).

R. Additional Terms applicable to .SYDNEY Domains

You agree that you will comply with, and require all Registrants to comply with, all applicable laws, terms and conditions, regulations, rules and policies of the Registry as updated from time to time on http://nic.sydney/. Domain Name Policies for .SYDNEY are located at http://nic.sydney/.
